Stanislav Dobshevich commented on the court decision regarding Raven Russia assets for the Logirus Logistics Portal.

The Arbitration Court of Moscow has satisfied the claim of the Prosecutor General’s Office to nationalize stakes and shares of 17 companies of Raven Russia group that operates 16 transport terminals with the area of 2 million sq. m.

 

If Raven Russia’s warehouses are taken over by the government, the existing lease agreements will not be terminated and will continue in force under the existing terms and conditions, only the lessor will be replaced, since the transfer of ownership title to the leased property to another person does not serve as a basis for modification or termination of lease agreements.

 

Filing an appeal is not possible until the court judgment is handed down, after that Raven Russia will have one month to file its appeal. The judgment will enter into force either after the appellate court’s ruling or after the expiration of the period for appeal.

 

However, the court may order the enforcement of the judgment with immediate effect if due to special circumstances, a delay may result in significant damage to the claimant or make enforcement impossible. This is provided for by Article 182.3 on the Enforcement of a Judgment or Court Order of the Arbitration Procedure Code of the Russian Federation. This way, there will be no waiting period of one month after the date of judgment and the warehouses will be transferred to the ownership of the government with immediate effect.
