Stanislav Dobshevich and Dmitry Raev Spoke at the DRC Conference "Time to Build: Managing Construction Contracts and Resolving Construction Disputes"
From April 22nd to 24th, with KKMP support, the Dispute Resolution Club forum "Time to Build: Managing Construction Contracts and Resolving Construction Disputes" took place.

KKMP Partner Stanislav Dobshevich spoke at the session "Industry in Focus: Oil & Gas. Dispute Resolution in Construction and Supply Contracts in the Oil & Gas Sector" with a presentation “Duty to Act in Good Faith and Mitigate Losses in Oil & Gas Contracts: An English Law Approach”.

 

During his presentation, Stanislav:

 

  • Compared the duty to act in good faith and the consequences of its violation under continental and English law;

  • Examined the grounds for the implied duty to act in good faith under English law;

  • Analyzed the relationship between the duty to act in good faith and the standard of a reasonable and prudent operator under English law; and also

  • Highlighted the specifics of the implied duty to mitigate losses under English law.

 

KKMP Counsel Dmitry Raev, in the "Port Infrastructure" session, discussed managing legal risks during the construction of port and other infrastructure facilities.

 

Topics covered included structuring projects using EPC, EPCF and EPCM models, the specifics of construction using PPP mechanisms, and other relevant issues.
