On October 2, KKMP partner Stanislav Dobshevich spoke at the session “Investment Arbitration in Emerging Markets: Opportunities and Risks” on the topic "State-owned entities acting as investors in investment treaty disputes".

Stanislav spoke about how public and private investors differ in the context of international investment arbitration and proposed an algorithm for determining whether a state-owned company performing public functions or acting as a state agent has the right of action under the 1965 Washington Convention.

On October 3, Senior Associate Natalia Andreeva spoke at the session “Overcoming Due Process Paranoia: Balancing Efficiency and Fairness in Decision Making”.

During the panel discussion Natalia defined the due process paranoia phenomenon, spoke about why it occurs, and proposed changes to the arbitration rules to deal with this problem.
