Elena Polevaya Participated in ICC Russia Meeting on Intellectual Property
An open meeting of ICC Russia on Intellectual Property was held on July 1st. The discussion focused on the new draft federal law “On the Platform Economy in the Russian Federation”, submitted by the Ministry of Economic Development to the Russian Government in February 2025.

The draft law aims to create a legal framework for the platform economy, regulating relations between platform operators, their partners, and users. This is the first attempt to systematically regulate the activities of digital platforms in Russia, such as OZON, Yandex.Market, and Wildberries.

 

Representatives from marketplaces, sellers, IP rights holders, and regulatory authorities discussed key problematic issues and the impact of the new legislative initiatives on Russia's largest marketplaces in a roundtable format, including:

 

  • The main legal problems of electronic platforms;

  • Widespread violations of IP rights in the electronic environment, the ineffectiveness of traditional countermeasures, and potential solutions for electronic platforms;

  • The limits of responsibility of electronic platforms, where the role of an information intermediary ends, and in what cases platforms are held liable;

  • Gray areas in platform activities: counterfeiting, combating gray imports, protecting consumer rights and IP rights holders, and rapid response to complaints.

We will continue to monitor the draft law and the development of case law.
