On July 31, together with partners from Rimon (USA), RK Partners (Austria), Radcliffe Chambers (UK) we hosted a joint webinar “Right to an Attorney: Understanding U.S., EU and UK Sanctions on Legal Services to Russian Persons”.

T. James Min II (Rimon, Partner), Lukas Roeper (RK Partners, Partner) and Shantanu Majumdar KC (Radcliffe Chambers, King's Counsel) discussed the sanction on legal services for Russian persons in U.S., EU and UK jurisdictions.

Key takeaways:

  • in all of the mentioned jurisdictions, the possibility of providing services depends both on the sanctioned status of the recipient of services and the place of its registration,

  • it is necessary to consider not only the restrictions on legal services, but other sanctions prohibitions on certain types of transactions, services and payments,

  • applicable restrictions depend not only on the location of the firm, but also on the nationality of the consultants working on the matter.

In August, several countries expanded their sanction lists to include Russian individuals and companies, and the US applied a new mechanism of secondary sanctions for the first time. Simultaneously, opportunities are emerging for the exchange of frozen assets. Cyprus has begun issuing the first licenses for asset withdrawal, and in Russia, the Central Bank has allowed foreigners to use funds in Type "C" accounts.
