Class-action lawsuits by “indirect participants” in 2025: cannot be filed, cannot be dismissed  - Изображение

The Center for Private Law Studies at the Department of Civil Law of the Faculty of Law at Moscow State University, in collaboration with the law firm “KKMP,” will host a lecture titled “Corporate Lawsuits by ‘Indirect Participants’ in 2025: Cannot Be Filed, Cannot Be Dismissed” on March 27, 2026, at 6:00 p.m.

The session will be led by Nelly Ivanova, a lawyer at KCMP. Nelly specializes in resolving major commercial and corporate disputes and has represented clients in a number of high-profile cases that received extensive media coverage.

During the session, we will discuss the concept of so-called “double indirect claims” and current approaches in Russian judicial practice regarding this issue. We will examine:

  • Practical Background to the Issue of Double Indirect Claims.

  • The Legal Framework for Bringing Double Indirect Claims, and Related Concepts Such as “Beneficiary,” “Corporate Veil,” and Others.

  • Criteria determining the right to a double derivative suit through the lens of current judicial practice: minimum shareholding in the corporation, the existence of a corporate conflict, and others.
