Igor Krasnov, Chief Justice of the Supreme Court of the Russian Federation (SC RF), has ordered the first-ever compilation in Russia of judicial precedents in cases involving the use of artificial intelligence (AI) technologies. The courts will need to determine how often the use of AI becomes the subject of a dispute or a legal violation across all types of legal proceedings. Particular attention will be paid to issues of compensation for harm caused by AI decisions and the selection of the appropriate defendant in such claims.
In analyzing judicial practice, attention will be focused on the following issues:
- protection of honor, dignity, and business reputation in cases of the dissemination of defamatory information generated using AI, including the use of deepfakes;
- protection of intellectual property, including when training AI on the results of intellectual activity without the consent of their authors (rights holders);
- examining administrative and criminal cases challenging decisions by government authorities made based on AI recommendations;
- recording offenses using video analytics and facial recognition systems;
- classifying crimes involving deepfakes, as well as fraudulent schemes using chatbots;
- courts’ recognition of documents and expert opinions generated by AI, as well as the practice of appealing judicial decisions on the grounds that the judge used AI tools to render them.
